By registering for or using Elevate Management, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.
Elevate Management provides software for property portfolios, body corporates, HOAs, and managing agents to manage units, owners, tenants, finances, communications, and related operations. Features depend on your subscription plan and enabled modules.
Paid plans, trial periods, and billing cycles are described during signup and in your subscription settings. Fees are charged via the payment methods configured (for example PayFast). Failure to pay may suspend access.
As a managing agent or administrator, you act as responsible party (or operator on behalf of a responsible party) for personal information you load about owners, tenants, and other data subjects. You must:
HexaCode provides the platform as an operator. We maintain the service, process account and billing data, and subprocess personal information as described in the Privacy Policy. We do not provide legal, tax, or accounting advice.
You must not:
The platform, branding, and documentation remain the property of HexaCode or its licensors. You retain ownership of data you upload. You grant us a licence to host and process that data to provide the service.
We aim for high availability but do not guarantee uninterrupted access. Maintenance, upgrades, and third-party outages may occur. Support is provided via configured channels for subscribed customers.
To the extent permitted by South African law, the service is provided "as is". Our total aggregate liability to you for any claim arising out of or relating to these terms or the service is limited to the total fees paid by you to us in the twelve months preceding the claim, except where liability cannot be limited by law.
You may stop using the service at any time. We may suspend or terminate access for breach of these terms or non-payment. Before closure, export your complex data using available export and reporting features where provided. After termination, we may retain certain data as described in section 13 and the Privacy Policy.
We retain platform account, billing, and operational data for as long as needed to provide the service, meet legal obligations, and resolve disputes.
You are responsible for determining appropriate retention periods for owner, tenant, levy, and trust records in accordance with STMA, CSOS, trust accounting, and POPIA requirements.
When the retention period you have determined expires, or when your account is terminated, we will securely delete or anonymise the data within a reasonable timeframe, except where we are required by law to retain it for longer. You may request a data destruction certificate upon request.
These terms are governed by the laws of the Republic of South Africa. Disputes should be resolved in South African courts unless otherwise agreed in writing.

We may update these Terms of Service from time to time. Material changes will be reflected by a new version number shown at the top of this page. Where required, continued use of the platform after notice may require renewed acceptance in the admin panel. The current version is 2026.06.01.
